I think you people are taking this the wrong way.  Read the article
first.  I think this /. post says summs it up best:

Having lockpicks isn't illegal. Using them in conjunction with a crime 
(breaking and entering, robbery, etc.) is illegal and a separate charge. 

There is no difference in having cracking tools. If I'm not cracking 
anything, then it doesn't matter. A quick look at the article indicates
 they were using those tools to crack machines. Thus, a separate charge.
